Terms And Conditions For Consignment Sales

Please fill out the form below and a representative from Dry Creek Arms will contact you to discuss your sale.  If Dry Creek Arms agrees to handle the sale, arrangements will be made for you to drop off the item(s) at our location or you will ship the item(s) to us via insured USPS delivery.

The Consignor represents that they are the rightful owner of the item(s) being sold and that the item(s) is clear of any legal claims or burdens.

While the Consignment Agreement is in effect, Consignor agrees to grant the exclusive right to Dry Creek Arms to market, advertise and sell the item(s).

The consignment fee shall be 20% of the final sales price of the item(s), with a minimum fee of $35 per firearm.  All applicable commissions, fees and expenses are deducted from the final sales price and the Consignor will receive the net sales amount either as an in-store credit or in the form of a check mailed to the Consignor’s address on record or an Electronic Funds Transfer (EFT) to an account provided by Consignor.

Dry Creek Arms will describe/list the items based on the information provided by the Consignor, but will not knowingly misrepresent items or list items at prices that are believed to be unrealistic or unfair.

The Consignment Period will be a minimum of sixty (60) days, unless the item(s) sells prior to the consignment period ending.  The Consignment Period will continue past the original 60-day agreement unless either party notifies the other of their intent to terminate it.  Because a sale may potentially be in progress and/or an advertisement may have just been placed, the Consignor agrees to give Dry Creek Arms thirty (30) days’ notice to either complete the sale or return any item(s) covered under the Consignment Agreement.

If the Consignor opts to have the consigned item(s) returned, Federal Law requires that the Consignor complete all appropriate forms as if they were purchasing the firearm(s) and pass the NICS background check.  If the Consignor fails to pass the NICS check, they will have thirty (30) business days to resolve the issue; if the issue cannot be resolved, the firearm then becomes the permanent property of Dry Creek Arms.
